I. Scope and Contracting Parties
These Terms and Conditions, as amended from time to time, apply to all orders placed through our Online Store at www.loui.rocks. If purchase agreements are concluded through our Online Store, they are concluded with loui.rocks GmbH (hereinafter referred to as "loui.rocks" or "we"). Our online store is aimed exclusively at customers who have reached the age of 18. Please note that these modalities are not mandatory requirements for the effective exercise of the legal right of withdrawal.
II. YOUR LOUI.ROCKS ACCOUNT
On loui.rocks you can store as a REGISTERED customer. The registration process is very simple. We only ask you for the basic information needed for the purchase process. In the registration form, all fields marked with a (*) are required. As a registered customer, your order information is available at any time through your account.
2. ORDER PROCEDURE
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before shipping your binding order by using the appropriate correction tools explained in the ordering process. By clicking the order button, you place a binding order for the goods in the shopping cart. Immediately after you send the order, you will receive a receipt confirmation by e-mail. This does not yet imply acceptance of the offer, but merely documents that the request has been received by us.
You can save the items you like most on your notepad. This way you will always have them at hand. It is very easy to use: every time you click on the heart symbol, you add this item to your notepad. You can choose whether to save it to a new or existing list. The edit option lets you remove items from the list or share public lists with others via a link at any time. To complete the purchase, click on the product, add it to the shopping cart and continue with the usual steps. Remember that you can only use the notepad if you are a registered and logged in customer. Items on the notepad do not guarantee product availability.
4. Shopping Basket
In the shopping basket, you can view the contents and change or delete the number of items in your order. You can also mark items you want to purchase later. Please note that an item in the basket cannot be reserved and therefore delivery cannot be guaranteed. If one of the items is no longer available, you will see this in the shopping cart. You can place a binding order for the selected goods at any time by clicking on the "order subject to payment" button in the shopping cart. You are bound by this request for a period of two (2) weeks after placing the order. In any case, by placing your order, you agree to the validity of the Terms and Conditions valid at the time of the order.
5. CHANGE ORDER
After completing your order, we will send you a confirmation email with the details. Please note that - apart from your right of withdrawal - it is not possible to cancel or change your order if it is already at an advanced stage of preparation or shipment.
6. CREATION OF THE CONTRACT
When the contract with us is formed depends on the payment method you choose:
Invoice & credit card
If you place an order by invoice or credit card, we will accept your order by sending an acceptance notice in a separate email or by delivering the goods within one week.
During the ordering process you will be redirected to the website of the online payment provider PayPal. There you can enter your payment details and confirm the payment order to PayPal. After you have placed your order in the shop, we will ask PayPal to initiate the payment transaction and thus accept your offer

SOFORT bank transfer

7. CONTENT OF THE CONTRACT
Together with the order confirmation or in a separate e-mail, but at the latest upon delivery of the ordered goods, we provide you with the content of the contract in German or English, which consists of the order confirmation and the GTC.
To help you find the right size, we provide size charts that show you the correct size based on your measurements. If we have more information about how the item fits, we'll tell you on the item's detail page.2. MATERIAL
At loui.rocks and in our store, you will get detailed information about the material & composition of each item. At loui.rocks, we place the highest value on quality & durability.
On our website, under MATERIAL of each item and on the labels of our garments, you will find information on how best to maintain your clothes. Follow the manufacturer's care instructions on the label. We also recommend KAELLE care products for all our products.

V. PRICES, PAYMENT AND OWNERSHIP
All prices on our website include VAT at the applicable rate. Delivery will be made to the delivery address you provide. Any shipping costs will be notified to you during the ordering process and will be at your expense. The price including VAT and applicable shipping costs will also be displayed in the order mask before you submit the order.
2. PAYMENT METHODS
The following payment methods are currently available:
a) Cash payment on collection
. When you pick up the goods you ordered, you can pay for the goods there directly in cash or with the payment methods available in our store.
b) Credit card: VISA, Master, American Express, Maestro (debit card)
If you choose the credit card payment method, you will provide your credit card information to us at the time of placing the order. After your identification as a legitimate cardholder, we will request the credit card company to initiate the payment transaction immediately after shipment of the goods. The payment transaction will be performed automatically by the credit card company and your card will be charged.
If you use the PayPal payment method, you will be directed to the website of the online payment provider PayPal during the ordering process. To pay the invoice amount via PayPal, you must be registered there or log in first, identify yourself with your access data and confirm the payment order to us. After placing the order in our online store, we ask PayPal to initiate the payment transaction. The payment transaction is performed automatically by PayPal. You will receive further instructions during the ordering process.
e) SOFORT bank transfer
If you use the payment method SOFORT Überweisung, you will be redirected to the website of the online provider SOFORT Überweisung after placing the order. To pay the invoice amount via SOFORT Überweisung, you must have an online bank account activated for participation in SOFORT Überweisung with PIN/TAN procedure, identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be executed immediately thereafter by SOFORT Überweisung and your account will be debited.
3. TIME OF PAYMENT
Your purchase will be charged as soon as your order is shipped. If you paid by PayPal, Paypal Express or Gift Card, payment will be made immediately after purchase. It is required by law to perform two-factor authentication for online transactions to verify identity. Please contact your financial institution directly for the pre-authorization release option. In case of immediate authorization, the debit amount will be shown to you immediately, otherwise it will be released for payment after identity verification.
4. BILLING FOR BUSINESS
If you want to purchase as a business, just click on the "Business" option in the personal information and enter the tax information we request.
5. OWNERSHIP RESERVATION
The goods remain our property until full payment is received. The buyer is obliged to treat the delivered goods with care as long as our retention of title to the delivered goods exists. If the buyer does not fulfill his contractual obligations, in particular in case of default of payment, we are entitled to reclaim the delivered goods; in this case the buyer is obliged to surrender the goods.
6. GIFT CARD (Voucher)
. There are two variants: (i) the E-card, a virtual card that is sent by email or can be deposited into the account, and (ii) the Gift Card, a physical card sent by courier. Both can be used in our store and on loui.rocks.
Useful information about the gift card:
Valid only in the country/region where the card is purchased. It is a bearer document. loui.rocks will not replace the card in case of theft, loss or damage. Vouchers are only transferable until they are assigned to a customer account. The validity period varies by country/region. You can see this information when you select your card. You can view the balance of gift vouchers in the loui.rocks Online Shop, in the My Account > My Gift Vouchers section. Gift cards are not redeemable and cannot be used to pay for other gift cards.
a) Paying with a gift card
Before you use your card, it is important that you know the following: Both physical gift cards purchased in our store and e-cards sent by email have already been activated. To use the gift card, login to your account or re-register and enter the unique voucher code in the shopping cart. This will assign the gift card to an account and it cannot be used elsewhere. If you want to use your e-gift card to pay in our store, you can print it or display it on your mobile device. If your purchase exceeds the balance of your gift card, you can combine it with any other payment method available in your country/region. In individual cases, only payment of the balance by credit or debit card is possible.
b) Returning with gift card
Items you return that were paid for with a gift card will be credited to your customer account in the same amount as the payment and can be viewed there under My Account My Vouchers. The credit will be applied to future purchases. Vouchers from promotions expire when items from the promotion are returned.

1. COLLECTION FROM LOUI.ROCKS STORE
GREE pickup at our store after 1-3 business days. Please note that the person coming to pick up the order must provide all proof of purchase, whether he/she is the buyer or someone else. If you authorize someone else to pick up the order, we need a written power of attorney and a copy of the buyer's ID, as well as proof of identity from the person coming to pick up the order.
2. DELIVERY HOME
a) Available shipping options:
Standard shipping: 5,95 EUR / FREE for orders over 300€.
Estimated delivery time varies from 1-3 working days depending on the delivery address.
Express delivery within Germany: 15,95 EUR.
Estimated delivery time varies between 1-2 business days. Please note that express deliveries can only be delivered on business days (Mon-Fri).
b) No delivery to Packstations
Generally, we cannot deliver packages to packing stations or mailboxes at this time.
c) Partial deliveries
We have the right to make partial deliveries when it is reasonable for you to do so. If we fulfill your order by partial deliveries, you will incur shipping costs only for the first partial delivery. If partial deliveries are made at your request, we will charge shipping costs for each partial delivery.
3. STATUS OF YOUR ORDER
We will inform you by email about the status of your order. You can also view this information in the "My Account" section. Restrictions: The company loui.rocks tries to enable deliveries to any location in Germany. If there are restrictions on delivery to your delivery address, you will see this when you enter your address or we will contact you as soon as possible to enable immediate delivery to a valid address or inform you of alternatives.
4. TRANSPORT DAMAGE
If goods are delivered with obvious shipping damage, you should complain to the delivery person as soon as possible and contact us immediately. Failure to complain or contact us will not affect your legal claims and their enforcement, in particular your warranty rights. However, by doing so, you are helping us to enforce our own claims against the carrier or shipping insurance company.
If products you buy from us do not meet the desired quality or show damage, you can invoke the statutory warranty rights.
If you wish to return an item purchased on loui.rocks, you have 30 days from the shipping date to return your order free of charge. Please note that we must have received the items within this period. The items must be in perfect condition and all labels must be present. In the loui.rocks store:
You can return your order in our loui.rocks store. To do this, simply present the items you wish to return and your proof of purchase. This can be submitted electronically or in printed form. You can also have another authorized person complete the return at our store.
How to find your proof of purchase:
Log in to your loui.rocks account with your username and password. You can download your proof of purchase from the order details of the order you wish to return. You can find our loui.rocks store here.
3. HOW IT WORKS
a) How do I proceed if I want to return my order?
If you want to return your order, you can easily return it to us. To do so, stick the label clearly visible on the outside of your package and deliver it to a UPS store.
b) How long can I return my order?
If you wish to return one or more items, you have 30 days from receipt of the goods to do so. To meet the deadline, the date on which the return was initiated and handed to the sender is decisive.
c) Do I have to pay for the return?
The return shipping is free for you within Germany. For orders from abroad, the return shipping costs are borne by the buyer.
d) Can I exchange the size or color of my article in the store?
If an item is available in a different size or color, you can exchange it in one of our Loui.rocks stores. If you cannot find anything suitable on site, we will gladly give you a voucher for the value of the exchange. In addition to the item you want to exchange, we also need the order or shipping confirmation that accompanies the item. If you want to exchange an item online, return it and make a new purchase.
e) Are there any items that are excluded from exchange?
In principle, any item purchased through the online shop can be returned within the specified period. Only gift certificates or gift cards are excluded. Hygiene items such as underwear or swimwear may only be tried on over other laundry, returned in the unopened original packaging and the hygiene film must not be damaged. Here, we reserve the right to decide on a case-by-case basis and refuse a return if necessary. Independent of this, returned items can only be refunded if they are returned in their original packaging, undamaged, unworn, unwashed and with all labels and receipts.
f) How long does it take for my refund to appear in my account?
Once you see in the tracking that we have received your return, it currently takes approximately 7 days to verify and credit it. Occasionally there may be a slight delay in crediting due to special events such as the current COVID-19 situation. Please note that there may also be delays of up to a week due to payment runs from your bank or credit union which cannot be affected.
g) Special conditions
In principle, all our items have a label and seal. These must be present on the garment for a successful exchange. For some of our items, the following additional special conditions for returns apply:
Ladies' underwear: exchange or return is possible as long as the items are in original condition and the bag or protective stickers with which we shipped them have not been removed. Men's underwear: items from the underwear collection cannot be exchanged or returned
Pajamas: Exchanges or returns will be accepted as long as items are in original condition. Items shipped with a bag must be returned with the bag. Accessories: must be returned in the complete original box or bag.
Returns will be made using the same payment method you used to make your purchase. You will receive an email confirmation of the return once it has been completed and we have received the goods back. If you have not received a refund after 14 days, please contact our customer service team.
If and insofar as you purchase from our online store as a consumer within the meaning of Section 13 of the German Civil Code (BGB), you have a statutory right of withdrawal after the conclusion of such a distance purchase, about which we inform you below in accordance with the statutory model.
Right of withdrawal
You have the right to revoke this agreement within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you or a third party, other than the carrier and named by you, received or took delivery of the goods. To exercise your right of revocation, you must inform us (loui.rocks GmbH, Bredeneyer Str. 48, 45133 Essen, telephone number: 0201-84323722, e-mail: [email protected]) of your decision to revoke this contract by means of a clear statement (e.g. a letter by post, fax or e-mail). You may use the attached model withdrawal form for this purpose, which is, however, not obligatory. To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we must refund to you all payments we have received from you, including the costs of delivery (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the inexpensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund. We may refuse a refund until we have recovered the goods or until you have provided evidence that you have returned the goods, whichever is earlier. You must return or hand over the goods to us without delay and in any event no later than fourteen days from the day you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiration of the fourteen-day period. You bear the direct costs of returning the goods. You only have to pay the depreciation of the goods if this depreciation is due to treatment of the goods that is not necessary for testing the condition, properties and functioning of the goods.

1. Dispute Resolution
The European Commission provides an online dispute resolution (ADR) platform which you can find https://ec.europa.eu/consumers/odr/.
We are not obligated or willing to participate in consumer arbitration dispute resolution procedures.
2. Severability clause
Should individual provisions of the contract with the customer, including these GTC, be or become invalid in whole or in part, or should the agreements contain a loophole, this shall not affect the validity of the remaining provisions.
